DMCA Policy

We are acutely aware of the paramount importance of protecting intellectual property. "Overly Controlling Or Protective" is unequivocally committed to upholding the Digital Millennium Copyright Act ("DMCA") and ensuring that our platform remains a sanctuary for lawfully created content. This policy outlines the stringent procedures we have established for addressing alleged copyright infringements, designed to protect not only the rights of copyright holders but also the integrity of our platform and the well-being of our content creators. Misuse of this process will not be tolerated, and we reserve the right to take disciplinary action against those who submit false or frivolous claims.

Filing a Notice of Alleged Infringement

If you believe that content hosted on our platform infringes upon your copyrighted work, you must submit a notice of infringement that adheres strictly to the DMCA's requirements. We demand meticulous accuracy and complete information to proceed. Failure to provide all requested details with precision will result in the immediate rejection of your notice, and we will not be held responsible for any subsequent delay.

  1. Your precise physical or electronic signature. This is non-negotiable and must be verifiable.
  2. A detailed identification of the copyrighted work(s) you claim have been infringed. Be specific; ambiguity is unacceptable and will result in dismissal.
  3. A clear and exact identification of the material on our platform that you claim is infringing, including its URL or other specific location sufficient for us to locate it without ambiguity. You are solely responsible for pinpointing the exact content in question.
  4. Your complete contact information: full legal name, physical mailing address, telephone number, and email address. We must be able to reach you directly and without delay.
  5. A statement from you affirming, under penalty of perjury, that you possess a good faith belief that the disputed use of the material is not authorized by the copyright owner, its agent, or the law. This statement must be truthful and demonstrably verifiable.
  6. A statement from you affirming, under penalty of perjury, that the information provided in your notice is accurate and that you are the copyright owner or expressly authorized to act on behalf of the copyright owner. False claims will be vigorously pursued and may lead to legal consequences against the claimant.

Once a fully compliant notice is received, we will take appropriate action, which may include the immediate removal of the identified content. We reserve the right to scrutinize all claims rigorously and to make the final determination regarding validity.

Counter-Notification Process

Should your content be removed or access to it disabled due to a copyright infringement notice, and you firmly believe the removal was erroneous or a result of misidentification, you are permitted to submit a counter-notification. Be warned: this is a serious legal assertion, and you will bear the full legal responsibility for any misrepresentation or false claim within your counter-notification.

  • Your precise physical or electronic signature. No exceptions will be made for this critical authentication.
  • Identification of the material that has been removed or to which access has been disabled, and the exact location (URL) where the material appeared before it was removed or disabled. You must recall and provide these specifics with absolute accuracy.
  • A solemn statement from you, under penalty of perjury, that you possess a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled. We expect absolute certainty and verifiable evidence here.
  • Your full legal name, physical mailing address, and telephone number. Your explicit consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or if your address is outside the United States, for any judicial district in which "Overly Controlling Or Protective" may be found), and that you will accept service of process from the person who provided the original notification of alleged infringement or an agent of such person. This is your unavoidable legal obligation.

Upon receipt of a valid counter-notification, we will forward it to the original claimant. We will then allow a designated period for their response, and we will ultimately decide the next steps, always prioritizing the integrity and security of our platform and its content.

All DMCA-related correspondence, notices, and counter-notifications must be submitted through our official channels. For further details or to initiate a claim, please visit our Contact Page. We will only review submissions made through the designated portal; submissions via other means will not be acknowledged or processed.
